Terms of Use

Welcome to Fuel Spy Australia (the "App"). These Terms of Use ("Terms") govern your access to and use of the App, including the mobile software application and its corresponding backend data servers, operated by MoneyMart ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

Fuel Spy Australia is a mobile service that allows users to search for local fuel prices. The App relies entirely on its proprietary backend server infrastructure to query, collate, and distribute real-time public government data streams. The App also leverages third-party mapping services to locate stations.

  • Advertisements: The App may include advertisements, sponsorships, or promotional links. We reserve the right to display these advertisements alongside our content and data streams at any time and without prior notice to you.

Official Data Sources & Attribution

To provide you with compiled pricing information, our backend system fetches data from official government open data portals. The data for each respective state is sourced from:

  • NSW, ACT and TAS: The New South Wales FuelCheck API Scheme
  • WA: The Western Australian FuelWatch API Feed
  • VIC: The Victorian Goveernmant Servo Saver Public API
  • Upcoming Inclusions: Support for Queensland (Offical FuelPrice API Scheme), Northern Territory (MyFuel NT), and South Australia (Offical FuelPrice API Scheme) is planned to be added soon.

2. No Warranties and "As Is" Disclaimer

  • Data Sourcing: The fuel price information displayed in the App is compiled straight from the state-provided open data APIs listed in Section 1.
  • "As Is" Basis: All information, software, and services provided through the App are delivered to you on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
  • No Accuracy Warranty: While our backend system constantly mirrors official state feeds, we act solely as a secondary distributor. We cannot and do not guarantee or warrant the accuracy, completeness, reliability, timeliness, or correctness of the fuel prices, station locations, or operating hours shown in the App.
  • User Verification: Fuel prices change frequently and retail networks can experience reporting delays to government registries. You acknowledge that any reliance on the data provided by the App is at your own risk, and you must verify prices at the physical pump before purchasing fuel.

3. Third-Party Mapping Services

The App integrates mapping functionalities to display fuel stations and calculate distances. By using this App, you acknowledge and agree to be bound by the terms of service of our third-party mapping providers:

  • Google Maps: Your use of features powered by Google Maps is subject to the Google Maps/Google Earth Additional Terms of Service.
  • Apple Maps: Your use of features powered by Apple Maps is subject to the Apple Maps Terms of Service.

4. User Accounts and Registration

  • Account Creation: To access certain features, you may be required to create an account, including through third-party social login providers.
  • Account Security: You are entirely responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
  • Age Requirement: You must be at least 16 years of age (or the legal driving age in your jurisdiction) to create an account and use this App.

5. Prohibited Conduct

You agree not to use the App to:

  • Violate any applicable local, state, national, or international laws.
  • Scrape, crawl, spider, or cache any data, content, or API endpoints from our backend servers for commercial purposes without our express written consent.
  • Attempt to disrupt, damage, overload, or interfere with the proper working of the App or its connected backend infrastructure.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Fuel Spy Australia, its affiliates, directors, employees, or data providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the App.
  • Any server downtime, transmission delays, or infrastructure errors.
  • Any inaccuracies, errors, or discrepancies between the prices listed in the App and the actual prices charged at retail fuel stations.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia and the state in which you reside, without regard to its conflict of law provisions.

8. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of this document. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.
